§ 38-101. Plant replacement.

(a)

Owners and their agents, heirs or assigns shall be responsible for the installation, preservation and maintenance of all planting and physical features required to satisfy the conditions of this article. Any dead or missing vegetation shall be replaced with like or similar plants within one calendar year.

(b)

When strict compliance with the requirements of this section would impose an undue hardship or expense on the applicant due to the size of the project, physical and/or geographic conditions, or other appropriate factors, then and in such event, the city council may approve such lesser or substitute landscaping plan as shall substantially comply with the intent and purposes of this article.
