§ 36-94. Private sewage disposal requirements.

  • Where a public sanitary sewer is not available under the provisions of subsection 36-93(d), the building sewer shall be connected to a private sewage disposal system complying with the provisions of this subsection.

    (1)

    A private sewage disposal system may not be constructed within the city boundary unless and until statement is obtained from the city stating that a public sewer is not accessible to the property and no sewer is proposed for construction in the immediate future.

    (2)

    Before commencement of construction of a private wastewater disposal system, the owner shall first obtain a written permit form Alamance or Orange County. The applicant shall supply any plans, specifications, and other information as is deemed necessary by the county.

    (3)

    A permit for a private wastewater disposal system issued by the county shall not become effective until the installation is completed to the satisfaction of the county whose designee shall be allowed to inspect the work at any stage of construction. The applicant for the permit shall notify the city and county when the work is ready for final inspection, and before any underground portions are covered. The plumbing inspection shall be made by the city and the system inspection shall be made by the county. Inspections shall be made within a reasonable period of time.

    (4)

    The type, capacity, location, and layout of a private wastewater disposal system shall comply with all recommendations of the State of North Carolina and the Alamance or Orange County Health Departments. No septic tank or cesspool shall be permitted to discharge to any natural outlet, drain, or open ditch.

    (5)

    The owner shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times and at no expense to the city.

    (6)

    No statement contained in the subsection shall be construed to interfere with any additional requirements that may be imposed by the county or state.

    (7)

    When a public sewer becomes available, in accordance with the provisions of subsection 36-93(d), the building sewer shall be connected to the municipal wastewater system within 60 days and the private disposal system shall be cleaned of sludge and filled with clean bank-run gravel or dirt.
