§ 32-36. Service requirements, construction timetable and line extensions.

  • (a)

    Within 24 months from the date of the award of a franchise under this article, or appropriate approvals from the FCC, the grantee must make the fully energized channel cable television service available to every dwelling unit within the city.

    (b)

    Notwithstanding any other provisions in this section, the grantee shall extend cable television service to any newly developed subdivision not later than final installation of all utilities services therein. A newly developed subdivision, for purposes of this section, means the division, combination or recombination of land into not less than ten residential lots, or building sites for the purpose of immediate or future sale or residential development, and the subdivision plat for which receives its final approval by the city after the effective date of this franchise, a copy of which showing easements shall be provided to the grantee within ten days of such approval.

    (c)

    With respect to requests for connection requiring an aerial drop line in excess of 200 feet, the grantee must extend and make available cable television service to such residents at a connection charge not to exceed the actual installation costs incurred by the grantee for the distance exceeding 200 feet.

    (d)

    As the city expands its boundaries through annexation, the grantee shall provide CATV services when the annexed area includes a minimum of ten houses and a density of not less than one house per acre.
