§ 22.12.3. Areas where smoking and the use of tobacco products and e-cigarettes are prohibited.

(a)

Smoking and the use of tobacco products and e-cigarettes are prohibited in the following locations:

(1)

City buildings;

(2)

City grounds;

(3)

City vehicles;

(4)

City parks, including without limitations, athletic fields;

(5)

City buildings and grounds and privately owned buildings and grounds while temporary special events or activities, as defined above, are taking place; and

(6)

On city sidewalks and streets in the district classified as the "business district" defined as follows:

a.

Clay Street and Center Street between Fifth Street and Second Street; and

b.

Fifth, Fourth, Third and Second Streets between Clay Street and Center Street.

(b)

Smoking and the use of tobacco products and e-cigarettes are not prohibited within the confines of private vehicles while parked on city grounds, in the city park system, or anywhere where smoking and the use of tobacco products and e-cigarettes are otherwise prohibited by this section.
