§ 22-1. Alcoholic beverages.
(a)
Adoption of state law. All the provisions of G.S. ch. 18B relating to the licensing and sale of whiskey, beer, wine and other beverages as defined therein which may be enforced by and on behalf of the city are adopted and made applicable to the city. The license taxes therein imposed shall be collected by the city tax collector and the regulations therein imposed shall be enforced by the proper officers of the city as they may be authorized by such chapter and by this section.
(b)
Consumption on public property. It shall be unlawful for any person to consume any alcoholic beverages in or on any public street, sidewalk, alley or other public property within the city; provided however, it shall be lawful for any person to purchase and consume malt beverages and unfortified wine at City owned facilities subject to and in accordance with all provisions of Chapter 18B of North Carolina General Statutes, and under policies and procedures of the city, as the same, may change from time to time. These policies and procedures may include general liability for the protection of the city, law enforcement protection and such other policies and procedures as authorized by the city manager. The city council authorizes the Manager to authorize possession and consumption of malt beverages and/or unfortified wine at a community center event or festival in accordance with such policies and procedures.
(c)
Display of opened bottles, etc., in public places. It shall be unlawful for any person to display any opened bottle, can or other container for alcoholic beverages on or in any public street, sidewalk, alley or other public property within the city except as specifically authorized by the foregoing.
(d)
Pursuant to the authority granted by S.L. 2017-87 any establishment located in the corporate limits of Mebane and holding an ABC permit issued pursuant to G.S. 18B-1001 is permitted to sell beverages allowed by its permit beginning at 10:00 a.m. on Sundays. All laws and clauses of law in conflict herewith are repealed to the extent of any such conflict.
